The Police are rarely asked to give evidence in cases when a speeding prosecution is brought and therefore rarely asked to prove they have operated a device properly. The officer may not have been challenged previously, and may have difficulty in demonstrating an understanding of the various checks to perform on the equipment .
Where a speeding prosecution is based on the opinion of an eye-witnesses that a vehicle was speeding, even if the witness is a police officer, if this is the only evidence, and no speed recording device was used, there must be at least two witnesses who say that the vehicle was speeding.
