Making a Road Traffic Accident Claim

If you have been involved in a car accident or any other accident involving a motor vehicle, you may be entitled to compensation. Our expert road traffic accident claims team can advise you on your rights and everything you need to do to start a claim and have the best chance of securing a settlement.

When you contact us, we will give you a free, no obligation consultation to discuss your case. Our expert road traffic accident solicitors will listen to what happened then provide an impartial assessment of how strong we think your claim is. We may also be able to give an indication of the level of settlement you could be able to secure at this stage to help inform your decision about how to proceed.

As well as claims against another motorists’ insurer, we also have experience of claims through the Motor Insurers’ Bureau for drivers without insurance and ‘hit and run’ claims. This means that whatever the circumstances, we can help you get the compensation you deserve.

Start a road traffic accident claim now by contacting your local Graham Evans & Partners office or using the contact form on the right.

How to make a no win, no fee road traffic accident claim

Many people worry about the cost of funding a car accident claim, but in most cases this shouldn’t be an issue. We take on many of our clients on a conditional fee basis, commonly known as ‘no win, no fee’.

This means you don’t need to pay anything up front to start a claim – you only pay us if we win a settlement for you. If we are unable to secure compensation, you won’t owe us anything and if we do win a settlement, our fees will be based on a percentage of that settlement, so you will always keep the majority of your compensation.

We will then tell you if we think you have a good claim and whether we are willing to take it on. There is no obligation at that stage. You can simply tell us if you wish to proceed and at that stage we will formally accept your claim and write to you to confirm this and send all the information you need.

As with all personal injury compensation claims, you need to prove that another person was responsible for your personal injury. In practice the insurance company will deal with your claim on his/her behalf.

If you are a passenger in a vehicle that was involved in a collision, your personal injury compensation claim would be made against the insurance company of the person responsible for the accident, whether that is the driver of the vehicle you were travelling in or a third party driver (or both if necessary).
